Can I reapply for an esta with overstaying by 1 day due to grieving?

I was supposed to leave August 3rd but left August 4th instead because my gf had a miscarriage on July 13th at 12 weeks pregnant and was still miscarrying on August 2nd which is why I shifted my ticket to August 4th because we were going back to my home Country together. July 28th I was informed that my Dad had passed away. Being hit with both deaths made me depressed. I have my fathers death certificate and I have my girlfriends miscarriage paperwork. This is my gf’s account that I am using to write the question on by the way.

You can certainly reapply, but the ESTA will probably be denied. Anyone whose ESTA has been denied may apply for a B visa, an application that is evaluated by a consular officer. The officer will take into account the reason for your overstay (along with the rest of your application, including the purpose of your trip and so on) in deciding whether to grant the visa.
